Can I receive stress-related workers' compensation?

Stress and work often go hand in hand. But when the stress levels that are caused at work negatively impact your quality of life, this should not be acceptable. Too much stress can become a health issue, and should be taken seriously if it is affecting your ability to live your life.

This blog will provide a brief overview into what conditions should be present if you intend to make a claim for workers' compensation citing stressful working conditions.

Finding proof

A claim for any type of workers' compensation cannot be unfounded. You must be able to not only prove that you have the condition that you have cited, but also prove that the condition was caused by your working environment. Of course, it is impossible to say whether your working conditions were the sole cause of your stress, however, you should be able to make a case that it was the predominant cause, and that it was the most responsible factor.

It's difficult to be successful in a stress claim because it is almost impossible to prove the cause. Some states acknowledge that everyone suffers some amount of stress, so it is asked that you prove that you are suffering more stress than other people.

Workers' compensation conditions

You can usually claim workers' compensation for an injury you have suffered from the day you start work. However, when it comes to stress, many states require that you first must have been working at the company for 6 months. This is because it takes time for stress to develop.
