Black lung claims in Kentucky

Occupational diseases can be very common among industries such as coal mining, where pollution and toxicity can cause problems.

What are occupational diseases?

Occupational diseases are conditions and illnesses that you attained through the environment in which you work. They are created by hazards or overexposure to factors present where you work. Therefore, you do not have much control over your exposure to them. Because these illnesses are a side effect of your work, it is possible to get compensation for damages to help you with the implications.

Coal workers' pneumoconiosis

Coal workers' pneumoconiosis (CWP) is the most frequently reported occupational disease in Kentucky. It is so common because it occurs after a person inhales coal dust over a long period of time. The condition is often colloquially termed as black lung. There are specific benefits and guidelines for sufferers of black lung.

How are black lung claims filed?

First off, in order to make a claim for black lung, you must be formally diagnosed by a physician. They will take an X-ray of your lungs to make this determination. You must include an interpretation of your X-ray in your filing. You then must file an Application for Resolution of Occupational Disease Claim (Form 102). Your filing will be assessed by a commission to determine the extent of your disability and what your benefits should be.
